Acceptance of Terms

By accessing and using the services provided by hsianzuem B.V. ("Company," "we," "our," or "us"), including our website hsianzuem.top and property maintenance services, you ("Client," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services. These Terms constitute a legally binding agreement between you and hsianzuem.

hsianzuem B.V. is a Dutch limited liability company registered with the Chamber of Commerce under number 92736845. Our VAT number is NL451927368B153. We are located at Stationsweg 167, 1360 GJ Almere, Flevoland, Netherlands.

Services Provided

hsianzuem provides property maintenance services including but not limited to general repairs, painting and decorating, preventive maintenance, and emergency services for residential and commercial properties. All services are subject to availability and our professional assessment of the work required.

Service Agreements and Quotes

All service agreements must be confirmed in writing, either through signed contracts or written acceptance of quotes. Quotes are valid for 30 days unless otherwise specified. Prices may be subject to change based on unforeseen circumstances or changes in scope of work, with prior notification to the client.

Payment Terms

Payment terms will be specified in individual service agreements. Generally, payment is due within 30 days of invoice date unless otherwise agreed. Late payments may incur additional charges. For larger projects, we may require deposits or progress payments as outlined in the service agreement.

Intellectual Property

All content on the hsianzuem website, including text, graphics, logos, images, and software, is the property of hsianzuem B.V. and is protected by Dutch and international copyright laws. You may not reproduce, distribute, modify, or create derivative works of our content without express written permission. Our company name, logo, and service marks are trademarks of hsianzuem B.V.

Warranties and Guarantees

We warrant that our services will be performed in a professional manner in accordance with industry standards. Specific warranties for materials and workmanship will be detailed in individual service agreements. We guarantee to remedy any defects in our workmanship within the warranty period specified in your service agreement.

Limitation of Liability

To the maximum extent permitted by Dutch law, hsianzuem B.V.'s total liability for any claims arising from our services shall not exceed the total amount paid by the client for the specific services giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption, even if we have been advised of the possibility of such damages. This limitation applies regardless of the legal theory upon which the claim is based.

Force Majeure

hsianzuem shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, government actions, or supply chain disruptions.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Termination

Either party may terminate a service agreement with written notice as specified in the individual agreement. hsianzuem reserves the right to terminate services immediately if the client breaches these Terms or fails to pay according to agreed terms. Upon termination, the client remains liable for all services performed and expenses incurred up to the date of termination. Termination does not affect either party's rights and obligations that accrued before termination.

Dispute Resolution

We encourage clients to contact us directly to resolve any concerns. If a dispute cannot be resolved through direct communication, it may be submitted to mediation through a recognised mediation service in the Netherlands. If mediation is unsuccessful, disputes will be resolved through binding arbitration in accordance with Dutch arbitration rules.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any legal proceedings arising from these Terms or our services shall be subject to the exclusive jurisdiction of the competent courts in Almere, Netherlands. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Insurance and Licensing

hsianzuem maintains appropriate professional liability insurance and complies with all applicable licensing requirements in the Netherlands. Proof of insurance and licensing can be provided upon request.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the modified Terms. For ongoing service agreements, material changes will be communicated directly to affected clients.

Entire Agreement

These Terms, together with any written service agreements and our Privacy Policy, constitute the entire agreement between you and hsianzuem regarding the use of our services. These Terms supersede all prior agreements and understandings, whether written or oral.
